Advance rent (rent advance)

Last checked 13 October 2026 · Checked by the Property Centre content team

Advance rent is rent paid upfront before or at the start of a tenancy, covering months the tenant has not yet lived there. Ghana's Rent Act caps how much advance a landlord may demand, but landlords commonly ask for far more, which Rent Control treats as unlawful and has asked tenants to report.

How advance rent works in Ghana

Paying rent in advance is normal in Ghana. What the law limits is how much can be demanded. The cap in the Rent Act is shown in the figures on this page.

In practice the gap between law and market is wide. Landlords in Accra and other cities often ask for far more than the legal cap upfront (see Sources differ). Tenants pay because supply is tight and they need the home. Rent Control has said it would enforce the cap strictly from April 2026, and has asked tenants to report landlords and agents who demand more.

Who is responsible: the offence lies with the landlord or agent who demands or accepts the excess. Tenants who report a breach can take their receipts and tenancy agreement to Rent Control.

The large advance also affects how much you pay an agent, because agents often charge a share of the whole advance rather than the legal basis; see agent commission.

A replacement rent law is being drafted. Earlier versions of the bill would have changed the cap, but nothing has been passed; see the proposed-law box.

Negotiating. Some landlords accept a shorter advance for a higher monthly rent or a longer agreement. Whatever you agree, put it in writing and pay by traceable means.

Differences by region

The cap is national. Large advance demands are reported most in Greater Accra and Kumasi, where demand for rented homes is highest. In smaller towns, shorter advances are more common.

What to check

  • How much advance is being asked, against the legal cap.
  • That the tenancy agreement records the amount you actually pay.
  • That you get a receipt for every payment, ideally by bank transfer or mobile money.
  • Who receives the money: the landlord, or a licensed agent.

Red flags

  • An agreement written to show a smaller advance than you paid.
  • Pressure to pay a multi-year advance in cash.
  • A landlord who refuses a receipt.

1963 (as amended)

Proposed, not yet law

The government plans to repeal the Rent Act 1963 (Act 220) and PNDCL 138 and replace them with one consolidated Rent Act. The Minister for Works, Housing and Water Resources told Parliament in June 2026 that the bill would be tabled by the end of the year. Its content has not been published, so nothing in it is law. An earlier Rent Bill, approved by Cabinet in November 2022 and sent to the previous Parliament, lapsed when that Parliament ended.

Status: being drafted by the Ministry; not laid in Parliament as of 13 October 2026 (confirmed 13 October 2026).

The legal cap is shown in the figures on this page. Anything a landlord demands above it is unlawful under the Rent Act.

Is two years rent advance legal in Ghana?

No. It is common in practice, but it is above the legal cap and Rent Control treats it as an offence by the landlord.

Yes. Take your receipts and agreement to the Rent Control office for the area. The Department has asked tenants to report such demands.

What is the penalty for collecting excess advance rent?

Officials and sources give different figures; see the Sources differ box.

Will the new Rent Bill change the advance rent rule?

It might, but the bill has not been published or passed; see the proposed-law box.
