Leasehold

Last checked 19 October 2026 · Checked by the Property Centre content team

Leasehold is the right to hold land for a fixed term under a lease from the allodial or freehold owner, usually with ground rent and conditions. It is the normal interest a buyer receives in Ghana. When the term ends the holder must renew it with the landowner, so check how much of the term remains.

How leasehold works in Ghana

When you buy land or a house in Ghana, you almost always buy a lease. The landowner, whether a stool, skin, family or the State, keeps the underlying title and grants you the right to hold the land for a set number of years. The lease is set out in an indenture, which must be stamped and then registered or recorded at the Lands Commission.

Lease terms. The term is agreed in the lease. Ghanaian citizens are usually granted the longer term in the figures. A non-citizen can never hold a lease longer than the cap in the figures at any one time.

What you pay. Lessors often take a lump sum when the lease is granted and then a yearly ground rent for the land. The lease says how much ground rent is due and to whom.

Conditions. Leases usually include covenants: what the land may be used for and a rule that you need the lessor's consent before you sell, sublet or mortgage. On state land that consent comes from the Lands Commission; on customary land, from the allodial owner.

Buying an existing lease. If you buy a house from its current owner, you take over the remainder of their lease, not a fresh term. A house on a lease granted long ago may have far fewer years left than a new grant.

Renewal. Under the Land Act 2020, a Ghanaian leaseholder has a right to renew at the end of the term, but renewal is not free: the new price is negotiated with the lessor and should take account of improvements you made. A non-citizen has no automatic right to renew unless the lease provides for it. In either case you go back to the original grantor, or their successors, before the term ends.

Differences by region

The rules are national. Who grants the lease differs: a stool or skin, a clan or family, or the State through the Lands Commission on state land.

What to check

  • The start date and term in the indenture, and how many years are left.
  • An official search at the Lands Commission confirming the lease and the registered holder.
  • The ground rent, who it is paid to, and receipts showing it is up to date.
  • Whether the lessor's consent is needed to transfer the lease to you, and that it has been given.
  • Any renewal clause, especially if you are not a Ghanaian citizen.
  • That the use you plan matches the use allowed by the lease.

Red flags

  • A seller who cannot show the original lease from the landowner.
  • A lease to a non-citizen for longer than the legal cap.
  • An unstamped or unregistered indenture.
  • Years of unpaid ground rent.
  • An advert promising "freehold" for land that is in fact leased.

Questions

What happens when my land lease expires in Ghana?

You must renew it with the original grantor or their successors. Ghanaian citizens have a legal right to renew at a negotiated price; non-citizens only if the lease allows it.

How many years is a land lease in Ghana?

It depends on the lease. Citizens usually receive the longer term in the figures; non-citizens are capped at the shorter one.

Can I renew my lease in Ghana?

Citizens can, under the Land Act, but the price is negotiated. Non-citizens need a renewal clause in the lease or the lessor's agreement.

What is ground rent on leasehold land?

A yearly rent paid to the landowner for the land under the lease. The amount and payee are set in the lease.

How do I check how many years are left on a lease?

Read the start date and term in the indenture, and confirm the registered lease with an official search at the Lands Commission.

Do I need the landowner's consent to sell my leasehold?

Usually yes. Most leases need the lessor's consent before you sell, sublet or mortgage.
